Agreement to Terms

These Terms of Service (“Terms”) govern your use of the EventMonitor mobile application (“App”) operated by Best Minds (“we”, “us”, or “our”). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

Description of Service

EventMonitor is a mobile application that provides event monitoring capabilities. The App:

• Verifies your phone number via SMS
• Assigns you a unique 6-digit client ID
• Sends periodic status messages to our server
• Queues messages locally when offline and sends them when connectivity is restored

Account Registration

To use the App, you must:

• Provide a valid phone number that you own or are authorized to use
• Complete the SMS verification process
• Be at least 13 years of age

You are responsible for maintaining the security of your device and account. You agree to provide accurate, current, and complete information during registration.

Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App in any way that violates any applicable law or regulation
• Use another person’s phone number without their authorization
• Attempt to gain unauthorized access to our servers, systems, or networks
• Interfere with or disrupt the App or servers connected to the App
• Reverse engineer, decompile, or disassemble the App
• Use the App to transmit malicious code or harmful data
• Attempt to manipulate or falsify your client ID or status messages

Client ID

Upon successful registration, you will be assigned a unique 6-digit client ID. This ID is:

• Permanently associated with your account
• Non-transferable
• Used to identify your device in all communications with our server

You may not share, sell, or transfer your client ID to another person.

Status Messages

The App sends automatic status messages to our server approximately every 5 minutes. By using the App, you consent to:

• The automatic transmission of status messages in the background
• The storage of these messages on our servers
• The use of battery and network resources for this purpose

Offline Functionality

When your device is offline, messages are stored locally and transmitted when connectivity is restored. We are not responsible for delays in message delivery caused by network conditions, device settings, or other factors outside our control.

Intellectual Property

The App and its original content, features, and functionality are owned by Best Minds and are protected by international copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

Disclaimer of Warranties

The App is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express or implied, including but not limited to:

• Implied warranties of merchantability and fitness for a particular purpose
• That the App will be uninterrupted, timely, secure, or error-free
• That status messages will be delivered within any specific timeframe
• That the App will be compatible with all devices or operating system versions

Limitation of Liability

To the fullest extent permitted by applicable law, Best Minds shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the App, whether based on warranty, contract, tort, or any other legal theory.

Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:

• Your right to use the App will immediately cease
• We may delete your account data, including your client ID and stored messages

Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the “Last updated” date on this page. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
